These Terms explain the rules for using Funkel AI. By using funkel.ai, app.funkel.ai, or related support, billing, and integration features, you agree to them.
1. Definitions
Service means the Funkel AI website, app, workspaces, agents, campaigns, billing, integrations, APIs, and support.
You means the person or organization using the Service.
2. Account Terms
You must be at least 18 and able to enter into contracts. You are responsible for your login details and account activity.
Do not use bots to create accounts, abuse signup, or bypass access controls.
3. Payments and Billing
Stripe bills plans, add-ons, and credit packs purchased directly through Funkel AI. Microsoft bills subscriptions purchased through Microsoft Marketplace.
The billing provider shown at checkout handles payment collection and invoices for that purchase. Paid subscriptions renew on the schedule shown at checkout. Taxes may apply. Keep your billing information accurate with that provider.
Starting a paid plan authorizes recurring charges from its billing provider. Checkout shows your subscription price.
A locked renewal price continues while that subscription stays active, unless we agree otherwise.
New Standard subscriptions include a 30-day money-back guarantee if Funkel AI does not find qualified leads matching the buyer profile you approve.
A qualified lead means a person or account matching that approved buyer profile. It does not mean a guaranteed reply, booked meeting, sales opportunity, or customer.
Contact us within the first 30 days to request a refund. Afterward, fees are non-refundable except for proven billing errors or legal requirements.
4. Guarantee, Cancellation, and Nonpayment
Cancel subscriptions purchased directly through Funkel AI in Settings. Manage Microsoft Marketplace subscriptions through the Microsoft account or purchasing partner used for that subscription.
Each subscription is separate. Canceling one subscription does not cancel another. Direct subscription cancellation takes effect at the end of its current billing period. Marketplace cancellation and refund steps follow Microsoft's purchase terms.
Failed payments may pause campaigns, agents, credits, or connected accounts. After a grace period, we may disconnect senders to avoid provider costs.
5. Modifications and Availability
We may add, change, limit, or remove parts of the Service.
We try to announce material pricing or product changes in advance when practical.
6. Use of AI and Lead Data
AI analyzes signals, drafts outreach, and summarizes conversations. AI output and enrichment data can be incomplete, outdated, or incorrect.
You are responsible for reviewing drafts, deciding what gets sent, and following applicable laws and platform rules.
Campaigns can send automatically under your chosen settings. Some API actions start work or send messages without separate browser approval.
Review settings before launch or API use. Paid searches can consume credits without finding a suitable contact.
We do not guarantee contact accuracy, replies, meetings, or sales.
7. Acceptable Use
Do not use Funkel AI for unlawful, deceptive, abusive, or rights-infringing activity. This includes:
- Spam, harassment, or impersonation.
- Credential abuse or unauthorized access.
- Bypassing rate limits or safety controls.
- Reverse engineering or scraping Funkel AI.
- Violating data-protection, advertising, or platform rules.
8. Third-Party Platforms and Integrations
Funkel AI relies on external platforms, payment providers, and integrations you connect. Their own terms and policies also apply.
We are not affiliated with them unless stated. We are not responsible for their outages, API changes, restrictions, or account actions.
9. Intellectual Property and Feedback
We retain the rights in Funkel AI software, designs, and systems. You retain the rights in your content.
You grant us limited rights to host, process, and transmit your content to operate the Service.
We may use your feedback without restriction or compensation.
10. Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE". TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
11. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, FUNKEL AI WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, DATA, GOODWILL, OR BUSINESS INTERRUPTION. OUR TOTAL LIABILITY FOR CLAIMS ARISING OUT OF OR RELATED TO THE SERVICE WILL NOT EXCEED THE AMOUNTS YOU PAID US IN THE TWELVE MONTHS BEFORE THE CLAIM.
12. Termination
We may suspend or end access for Terms violations, legal or security risks, nonpayment, or platform abuse.
Terms that reasonably continue after termination remain in effect, including billing, liability limits, and intellectual-property terms.
13. Governing Law
These Terms are governed by German law, excluding conflict-of-laws rules and the UN Convention on Contracts for the International Sale of Goods (CISG). Where legally permitted, the place of jurisdiction is Cologne, Germany.
14. Changes
We may update these Terms. When we do, we will revise the date above. Continued use of the Service after the updated Terms take effect means you accept the revised version.
