These Terms of Service govern your access to and use of funkel.ai, app.funkel.ai, and related billing, integrations, and support workflows that make up the Funkel service. By using Funkel, you agree to these Terms.
1. Definitions
When we say Service, we mean the Funkel marketing site, the web application, and the connected features we provide, including billing flows, integrations, workspaces, agents, campaigns, and APIs or internal tools we may add later. When we say you, we mean the individual or organization using the Service.
2. Account Terms
You must be at least 18 years old and authorized to enter into binding contracts to use the Service. You are responsible for safeguarding your credentials and for all activity that happens under your account. You may not create accounts through bots or otherwise abuse signup, authentication, or access controls.
3. Payments and Billing
Paid subscriptions, add-ons, and credit packs are billed through Stripe. By starting a paid plan, you authorize recurring charges based on the cadence you select, which may be monthly, quarterly, or annual. Growth plan pricing may be cohort-based or otherwise limited at the time you check out. If your subscription locks a given renewal price and you keep that subscription active, that locked price stays with that subscription unless we explicitly agree otherwise.
You must provide complete and accurate billing information. Unless a law requires otherwise, fees are non-refundable except for proven billing errors. Taxes may apply and are your responsibility unless we state otherwise.
4. Trials, Cancellation, and Nonpayment
New paid subscriptions may include a 7-day free trial before the first recurring charge. You can cancel from settings at any time, and the cancellation takes effect at the end of the current billing period. If payment fails, we may pause campaigns, agents, credits, or connected accounts, and we may disconnect third-party sender accounts after a grace period to avoid ongoing external costs.
5. Modifications and Availability
We may change, improve, limit, or discontinue parts of the Service at any time. We aim to communicate material pricing or product changes in advance when practical, but the Service is offered on a rolling software basis rather than as a fixed feature set.
6. Use of AI and Lead Data
Funkel uses AI to analyze signals, draft outreach, and summarize conversation context. AI outputs, lead data, and enrichment data may be incomplete, outdated, or wrong. You are responsible for reviewing what Funkel drafts, deciding what gets sent, and complying with the laws, regulations, and platform terms that apply to your outreach.
7. Acceptable Use
You may not use the Service for unlawful, deceptive, abusive, or rights-infringing conduct. That includes spam, harassment, impersonation, credential abuse, unauthorized access, attempts to bypass rate limits or safety mechanisms, reverse engineering, scraping us, or using the Service in a way that violates data-protection, advertising, or platform rules.
8. Third-Party Platforms and Integrations
Funkel depends on third-party services and platforms, including LinkedIn, Unipile, Stripe, and integrations you choose to connect such as HubSpot, Slack, Telegram, Zapier, Make, n8n, or webhook endpoints. We are not affiliated with those platforms unless we explicitly say so, and your use of them remains subject to their own terms and policies. We are not responsible for outages, API changes, restrictions, or account actions imposed by those providers.
9. Intellectual Property and Feedback
We retain all rights in the Service, including the software, design, and underlying systems we build. You retain your rights in the content, messaging, and business materials you provide, but you grant us the limited rights needed to host, process, and transmit that content to operate the Service. If you send feedback, we may use it without restriction or compensation.
10. Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE". TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
11. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, FUNKEL WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, DATA, GOODWILL, OR BUSINESS INTERRUPTION. OUR TOTAL LIABILITY FOR CLAIMS ARISING OUT OF OR RELATED TO THE SERVICE WILL NOT EXCEED THE AMOUNTS YOU PAID US IN THE TWELVE MONTHS BEFORE THE CLAIM.
12. Termination
We may suspend or terminate access to the Service if you violate these Terms, create legal or security risk, fail to pay, or otherwise abuse the platform. Sections that should reasonably survive termination, including billing, limitations of liability, and intellectual-property terms, will survive.
13. Governing Law
These Terms are governed by the laws of the State of Delaware, USA, without regard to conflict-of-law principles.
14. Changes
We may update these Terms from time to time. When we do, we will revise the date above. Continued use of the Service after the updated Terms take effect constitutes acceptance of the revised version.
