These Terms explain the rules for using Funkel. By using funkel.ai, app.funkel.ai, or related support, billing, and integration features, you agree to them.
1. Definitions
When we say Service, we mean the Funkel website, app, workspaces, agents, campaigns, billing, integrations, APIs, and support flows. When we say you, we mean the person or organization using Funkel.
2. Account Terms
You must be at least 18 and allowed to enter into contracts. You are responsible for your login details and for activity under your account. Do not create accounts through bots, abuse signup, or try to bypass authentication or access controls.
3. Payments and Billing
Paid plans, add-ons, and credit packs are billed through Stripe. When you start a paid plan, you authorize recurring charges on the billing schedule you choose: monthly, quarterly, or annual. The price shown at checkout is the price for that subscription. If you have a locked renewal price and keep the subscription active, that price stays with that subscription unless we agree otherwise.
You must provide accurate billing information. New Growth subscriptions include a 30-day money-back guarantee if Funkel AI is not a fit, unless checkout says otherwise. To request a refund under this guarantee, contact us within the first 30 days of the subscription. After that window, fees are non-refundable except for proven billing errors or where the law requires otherwise. Taxes may apply.
4. Guarantee, Cancellation, and Nonpayment
You can cancel from settings at any time. Cancellation takes effect at the end of the current billing period. If payment fails, we may pause campaigns, agents, credits, or connected accounts. After a grace period, we may disconnect third-party sender accounts to avoid ongoing external costs.
5. Modifications and Availability
Funkel will change as the product improves. We may add, change, limit, or remove parts of the Service. When a pricing or product change is material, we try to communicate it in advance when practical.
6. Use of AI and Lead Data
Funkel uses AI to analyze signals, draft outreach, and summarize conversation context. AI output and enrichment data can be incomplete, outdated, or wrong. You are responsible for reviewing drafts, deciding what gets sent, and following the laws, regulations, and platform rules that apply to your outreach.
7. Acceptable Use
You may not use the Service for unlawful, deceptive, abusive, or rights-infringing conduct. That includes spam, harassment, impersonation, credential abuse, unauthorized access, attempts to bypass rate limits or safety mechanisms, reverse engineering, scraping Funkel, or using the Service in a way that violates data-protection, advertising, or platform rules.
8. Third-Party Platforms and Integrations
Funkel depends on third-party platforms and providers, including LinkedIn, Unipile, Stripe, and integrations you choose to connect such as HubSpot, Slack, Telegram, Zapier, Make, n8n, or webhook endpoints. We are not affiliated with those platforms unless we say so. Your use of them remains subject to their own terms and policies. We are not responsible for their outages, API changes, restrictions, or account actions.
9. Intellectual Property and Feedback
We retain the rights in Funkel, including the software, design, and systems we build. You keep the rights in your content, messages, and business materials. You give us the limited rights needed to host, process, and transmit that content to operate Funkel. If you send feedback, we may use it without restriction or compensation.
10. Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE". TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
11. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, FUNKEL WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, DATA, GOODWILL, OR BUSINESS INTERRUPTION. OUR TOTAL LIABILITY FOR CLAIMS ARISING OUT OF OR RELATED TO THE SERVICE WILL NOT EXCEED THE AMOUNTS YOU PAID US IN THE TWELVE MONTHS BEFORE THE CLAIM.
12. Termination
We may suspend or terminate access if you violate these Terms, create legal or security risk, fail to pay, or abuse the platform. Sections that should reasonably survive termination, including billing, limitations of liability, and intellectual-property terms, will survive.
13. Governing Law
These Terms are governed by German law, excluding conflict-of-laws rules and the UN Convention on Contracts for the International Sale of Goods (CISG). Where legally permitted, the place of jurisdiction is Cologne, Germany.
14. Changes
We may update these Terms. When we do, we will revise the date above. Continued use of the Service after the updated Terms take effect means you accept the revised version.
